It intends to give an overview of certain legal implications from a civil-law and regulatory perspective under the EU legal framework and attempts to discuss the question, whether the current approach by the European legislator, explicitly differentiating between the legal treatment of Crowdfunding and ICOs, is well founded or not. An extended version of this article has been accepted for presentation at the tenth annual TCD Law Colloquium hosted by the University of Dublin (Trinity College) School of Law in February 2018.
