Case 8941. File 1014. Entered May 9, 1923. Big Creek Coals, Inc., No. 3, Harrisburg.--A miner who was discharged for loading impurities asked to be reinstated with pay for lost time. It was taken up at the mine May 10th by Commissioner Davis and Sub-district Vice President Ford and disposed of as follows: "After viewing the impurities we agree that the quantity and appearance of the impurities would justify the discharge. Therefore the case is dropped." Case 8942. File 1190. Entered May 10, 1923. Sincerity Coal Co., Marion.--A miner who was discharged for interfering with the work of the driver asked to be reinstated with pay for lost time. It was taken up at the mine May 14th by Commissioner McArtor and Acting Board Member Wingett and agreed: "The evidence in the case and of Joe Ward (Williams' buddie) show that Mr. Williams did interfere with this driver by jerking him and he fell, which Mr. Williams should not have done. He should have gone to the mine manager if he was dissatisfied with the actions of the driver. However, under the circumstances, as there is some conflicting evidence in this case, we agree that Mr. Williams will be reinstated and the claim for compensation is denied, with the understanding that Mr. Williams will comply with the provisions of the State Agreement in the future."
