While we have very serious doubts as to our jurisdiction in any case of this kind, we have no doubt that we have no jurisdiction in this particular case, because some of the parties who owned the property and made the sale thereof are sui juris, and the only reason why the aid of this court was invoked was because the interest of these minors had to be conveyed in order to make the title complete. Clearly we have no jurisdiction over those of full age, and as the remedy is a joint one, which cannot well be severed, the proceedingsshould be in a court that can take jurisdiction of all concerned. The petition is dismissed. An appeal from an award oi arbitrators will be stricken ofl if it appears by the record' that the costs which may have accrued have not been paid in cash. Depositions were taken, and are on file, from which, and from the papers in the case, it appears that the defendant did not, on taking his appeal, pay all the costs (as they appear by the plaintiff's bill on file) in cash; that, in lieu of paying all the costs togthe Lewis v. Signor. prothonotary, he produced and filed receipts of witnesses and otiicers, stated, over their signatures, to be in full for their fees respectively.
